Honolulu Ocean Safety Chief suspended without pay pending investigation

HONOLULU (KHON2) — Honolulu Ocean Safety Division’s Chief, John Titchen, has been put on administrative leave pending an investigation according to the City.

Titchen’s attorney, Eric Seitz, told KHON2 there is no update as they wait to hear back from the Managing Director and the Mayor. KHON2 reached out to the Mayor’s office who said there’s no update at this time.

Meanwhile, the HGEA represents lifeguards, but directors are not covered by a collective bargaining agreement.

“Directors are not usually under union rules, they’re exempt employees and so because of that there is more leeway for the employer to suspend somebody without pay instead of with pay,” said Doug Chin, a legal expert.

Legal experts said, because this involves a director it’s unlike usual cases where other government employees would be suspended with pay.

“That’s because for most public employees they’re covered by union rules that strongly protect their rights including the rights to get paid regularly,” Chin said.

While information on the reason for the suspension is limited, City Council members said they’re keeping an eye on what happens next.

“We all take all these investigations seriously and Chief Titchen is entitled and has the right to due process while awaiting the results of the pending investigation,” said Val Okimoto, Honolulu City Council Public Safety Committee Chair. “I don’t believe this will hinder or impact the creation of a new Ocean Safety Department.”
