HONOLULU (KHON2) — In a Maui courtroom today, Arielle Konig, the wife of a Maui doctor accused of trying to kill her, has withdrawn her request for a restraining order.
She told the judge she no longer needs the temporary protection because her husband remains behind bars with no chance of release.
“My client believes at this time the TRO is not necessary to prevent further harm because he’s being held without bail and there’s no possibility of release at this time,” said her attorney, Brandon Segal.
In her original petition, Arielle detailed not just the assault back in March, but a history of abuse, including accusations of sexual assault and controlling behavior.
But with her husband now detained, her attorney said the restraining order became legally unnecessary.
Segal continued, “Ms Konig is doing well. She’s still recovering. She still has some injuries but she’s spending time with her family and one of the reasons why we also dismissed the TRO without prejudice at this time is because of the ongoing media coverage and having to testify for the grand jury. She’s made statements to police and so she just wants to get back to some semblance of normal life.”
Prosecutors allege that during a hike on Nuuanu trail, Gerhardt Konig attempted to push Arielle off a cliff, beat her with a rock the size of a softball, and tried to inject her with syringes.
“She’s not reminding her allegations, she’s not dropping her allegations, this is a procedural reason why we dropped this TRO, this TRO was dismissed only because of the custody status. She does intend to testify at trial.”
Gerhardt Konig waived his appearance from today’s hearing, where he is being held at Oahu Community Correctional Center on charges of attempted murder.
Last week, a judge denied his request for bail, agreeing with prosecutors that he was a flight risk and a danger to Arielle if he was released.

The court granted Konig’s request for dismissal without prejudice, meaning a TRO could be refiled if Gerhardt Konig’s custody status changes. His trial is scheduled to begin in June.
Arielle has since filed for divorce.
